BJP leader Varun Gandhi on Wednesday moved
the Supreme Court for a direction to the Uttar Pradesh government to accept
the Advisory Board's recommendation to the State to revoke the detention order
passed under the National Security Act.
Senior counsel Mukul Rohatgi mentioned the
filing of the writ petition before a three-judge Bench of Chief Justice K.G.
Balakrishnan, Justice P. Sathasivam and Justice Deepak Verma for listing it
on Thursday along with the writ petition challenging the preventive detention.
The court had granted him parole till May 14. The Bench posted it for hearing
on Thursday, when the U.P. government's application against the board's decision
would also be heard.
Mr. Gandhi, in his petition said the board
by its order dated May 8 had said "there is no sufficient ground to detain
the petitioner under the NSA" and directed the State government to revoke
the order dated March 29.
He said that in utter defiance of the board's
decision and disregard to Section 12 (2) of the NSA, the State failed to revoke
it. Instead it had filed an application seeking a direction to set aside the
recommendations of the board.
Mr. Gandhi sought a direction to the U.P.
government to revoke the detention order or alternatively quash it.
Also he wanted the court to direct the State
to pay compensation of Rs. 10 lakh to him to be deposited in favour of the
Supreme Court Legal Aid Services.
