The Bombay high court on Wednesday refused permission for a Congress party event at Shivaji Park stating that there have been violations in the past by organizers.
The court said it found that even after giving an undertaking there were “violations of conditions of its permission” by a political party and others resulting in flouting noise pollution norms and damage to the ground. “It’s high time that such applications must be discouraged. We are not inclined to grant permission,” said a bench headed by Justice S C Dharmadhikari.
The court heard a petition by the Congress to hold 128th foundation day on December 28. The party’s advocates, Mukesh Vashi and Rui Rodrigues, said the event was held in Mumbai in 2003 and 2006.
“This is the first time the party is approaching the high court after the park was declared a silence zone,” said Vashi, adding that the HC had passed orders granting permission to others. In a veiled reference to the Shiv Sena, he said another political party damaged pitches and violated decibel levels. Advocate Mihir Kamdar, appearing for Wecom Trust on whose petition, the HC declared the park a silence zone in May 2010, said the cricket season has begun and matches are scheduled. “This court must uphold the law,” said Kamdar. |
