The district magistrate had issued an order detaining Shahbuddin in jail saying he would influence the poll process and the law and order situation in Siwan.

After being released from jail on Thursday, Rashtriya Janata Dal’s strongman MP Mohammad Shahbuddin has declared that he will go to any extent to install his party’s government in the state, clearly indicating the use of muscle power in Bihar’s post-poll scenario.

Shahbuddin was released from Beur Central jail after Chief Minister Rabri Devi cancelled the Siwan District Magistrate’s order detaining him till the counting of votes is over on February 28.

Siwan DM, C K Anil had issued an order to detain Shahbuddin in jail under the Crime Control Act (CCA) till February 28, even though the Patna High Court had granted him regular bail on February 18. The DM had also banned the entry of the MP in Siwan district for six months, which still holds. Mr Anil in the order had underlined that Shahbuddin would influence the poll process as well the law and order situation in Siwan.

Justifying the release Chief Minister Rabri Devi said there was nothing wrong in it since the assembly elections were over.

Criminal charges

Shahbuddin is a dreaded name in Siwan and faces a number of serious criminal charges. The release of Shahbuddin and his statements has intensified the political temperature of the state where results of the assembly elections are awaited.

Immediately after being released the controversial MP told reporters that now he would do everything to pave the way for an RJD government. “I will go to the extreme, to any level and do anything and everything for making Rabri Devi the chief minister,” he declared and said the media was free to interpret it as they desired.

He charged the Election Commission of being guided by a rival party and said he would write to the Lok Sabha Speaker urging him to initiate privilege proceedings against the Siwan DM. He accused the DM of wrongfully applying CCA against him and obstructing the judicial process to detain him in jail after he was granted bail.

‘Misuse of power’

Meanwhile, the BJP has charged Chief Minister Rabri Devi of misusing her powers and faxed a letter to the Election Commission urging to quash her orders and direct that Shahbuddin be arrested. BJP MP and vice president Sushil Kumar Modi alleged that in the event of a hung assembly Shahbuddin’s muscle power would be used to manage MLAs to support the RJD. He said after the last assembly election the infamous MP had hijacked independent MLAs.

In another development, the Patna High Court too has sought an explanation from the Siwan DM asking to clarify as to on what grounds the MP was detained in jail and debarred from entering the district. The court sought the explanation responding to a petition from Shahbuddin.

Now it remains to be seen whether the Election Commission will take any step against the release, since the model code of conduct is still in force in Bihar.
