The Uttar Pradesh Government is likely to give permission to the
Central Bureau of Investigation (CBI) to start prosecution of
former health minister, Balram Yadav of the Samajwadi Party and
former secretary, medical education R K Sharma, in the Rs. 32-crore
ayurveda seam which would come up for hearing before a division
bench of the High Court tomorrow. Chief Minister Mayawati soon
after assuming office on March 21 has referred the CBI's request
for prosecution of Yadav and Sharma, to advocate general R N
Trivedi who is understood to have already submitted his opinion to
the Law Department. The government is expected to announce its
decision sanctioning their prosecution in the court tomorrow
itself.
Significantly, the court had directed the Advocate General to
assist the court during its next hearing of the case on April 10.
The former Health Minister and the senior IAS official were charged
with being patronized by Governor Romesh Bhandari who did not allow
the CBI to prosecute the two, taking the plea that evidence was not
enough to grant permission. The then Advocate General Shanti
Swaroop Bhatnagar had advised the Governor that the grounds were
insufficient to allow the CBI to go ahead on this front. The CBI,
however, sent a fresh letter to Bhandari urging him to reconsider
his decision but the issue was moth-bailed much to the
disgruntlement of the investigating agency and BJP.
