Sibal’s arguments could spell trouble for Sanjay Dutt

In the ongoing bail plea of Bharat Shah, who is being represented by noted lawyer and politician Kapil Sibal, there is uncertainty over the possibility of Shah getting bail. However, many feel that Sanjay Dutt could definitely get into trouble after Sibal’s arguments.

On Monday, advocate Sibal, while arguing the case said, “Dutt has directly spoken to Karachi-based Chhota Shakeel over the phone several times. Police even have a recording of the conversation. Yet he is a witness and Shah the accused.”

Interestingly, Sibal was also Dutt’s lawyer. It was only after Sibal’s arguments that he had got bail in the 1993 serial bomb blast case.

However, Sibal does not think that Dutt or anyone else will get into trouble after his arguments in the ongoing case.

Sibal said, “Several film personalities have talked to Chhota Shakeel over the telephone. What I am trying to say is that everybody in the film industry is acting under pressure. Witness’ statements mention that everybody had received threats from the underworld be it Sanjay Dutt, Mahesh Manjarekar, Sanjay Gupta, Bharat Shah.”

When asked why Shah had been singled out, he said, “There are some witnesses who were actively involved in the under-world. Mansoor Siddiqui contacted Shakeel to recover Rs 35 lakh from Sanjay Dutt. He was seeking extortion yet he is a witness in the case. Whereas Shah spoke to Shakeel only once, that too through Nazim Rizvi. He has been singled out for reasons best known to the police.”

Sibal has accused the police of exceeding their duty. “When the defence was given the case papers, some part was deleted without any court order.”

Transcripts of telephonic conversations of 56 people were given to Shah’s lawyers on July 13 only after they moved the application in the high court. Sibal said, “The prosecution has not followed procedures established by the law. The accused was denied the opportunity to defend himself. If they had given these documents earlier, the judge would not have ruled against Shah.”
