Chief Justice Ravi S Dhavan, sitting on a division bench of the Patna high court with Justice S K Singh on Wednesday, said that “total anarchy prevails in the state”.
The oral comment was made when the bench was hearing a memorandum submitted by the Bihar branch of Indian Medical Association (IMA).
The bench adjourned the hearing for Monday, as advocate general Shashi Anugrah Narayan did not turn up on Wednesday to place the government’s point of view-something the chief justice criticised sharply.
In the memorandum, the IMA has drawn the chief justice’s attention to the kidnapping of 33 doctors in the last 10 years, murder of four doctors in one year and extortion threats received by doctors from criminals in jail.
The chief justice observed, “The situation here is bad, which has never been faced by any of the high courts of the country ... Non-appearance of the advocate general despite issuing of court notice is also a violation of the constitution and a contempt of the court.”
Commenting on the report submitted to the bench by DGP Narayan Mishra, the chief justice said, “If you claim that 20 engineers were kidnapped during the last three and a half years and barring one or two, all were rescued, then the law-and-order situation in the state is good. But it is not good.”
Chief secretary K A H Subramanian
was directed by the chief justice to apprise the chief minister of the
situation arising out of the nonappearance of the advocate general.
