Shariah Protection Council, a Chennai-based organisation on Shariah, conducted a statewide sample survey on the AIMPLB's model Nikahnama in May. A total of 2,672 persons were interviewed. Muslims as well as people of other religions, people of different age groups, and with differing educational levels were covered in the survey. People both from urban and rural areas, and with differing marital status were also interviewed. One thousand five hundred and seventy Muslim men 1,102 Muslim women and 116 non-Muslims were covered in the survey.
Sixty-two percent of the respondents said that the Board is not competent to issue a fatwa banning triple talaq, only 17 percent said that the Board has the authority to ban triple talaq and 21 per cent said that they were not aware about it.
Sixty-nine percent were against ban on polygamy, 19 per cent were in favour of a ban, and 12 per cent said that they did not know.
Seventy-eight percent said that it was correct to approach a qazi for divorce as advised by the Board and only 11 per cent were against it.
Sixty-four percent of those interviewed said
that Family Courts are not best forum to solve matrimonial disputes and only
15 per cent were in favour of it. While eighty-one percent said that Shariah
Courts are the best forum to solve matrimonial disputes.
Seventy-seven percent said that wives did not have the same rights as of husbands
in the matters of divorce. Only 19 per cent said that wives had the same rights.
Eighty-eight percent said that the government should not ban triple talaq and polygamy and only 7 per cent of them were in favour of a ban on them by the government.
