Who failed during the Emergency? (Letter to Editor)

Lok Sabha speaker Somnath Chatterjee was partially true when he said that 'the judiciary had left citizens at the mercy of the executive during the Emergency (TOI, April 27). It is true that the supreme court had upheld the executive's decision to suspend the fundamental rights of people. However, Chatterjee seems to have forgotten that the executive headed by indira Gandhi then imposed the Emergency to protect her position as PM. And this was supported not only by Congress but by the communists as well. Now, the same executive is trying to impose 27 % reservation in central educational institutions without proper data. The only difference is that instead of using emergency provisions, Ninth Schedule is being eyed for the purpose. By repeatedly asserting that the elected representatives are supreme, the political leadership is subverting the Constitution.
